Article 1 – Scope of Application:
These General Terms and Conditions of Sale (referred to as “GTC”) apply, without restriction or reservation, to all users of the website www.sweet-oil.com, and to all sales concluded between the parties in France and abroad.
No specific conditions may prevail over these General Terms and Conditions of Sale and Use, unless expressly written and signed by the Client and the Seller. If any clause of these general terms and conditions of sale were to be null or void, the other clauses would not be affected.
By ordering a product offered for sale on the SWEET OIL website, the Buyer fully and completely accepts these General Terms and Conditions of Sale, which the Buyer acknowledges having read prior to placing the Order.
SWEET OIL reserves the right to modify these General Terms and Conditions of Sale at any time. However, the General Terms and Conditions of Sale applicable to the Order are those accepted by the Buyer on the date of the order.
The choice and purchase of a product are the sole responsibility of the Client.
Product offers are valid within the limits of available stocks, as specified during the order process.
These GTC are accessible at any time on the website www.sweet-oil.com and shall prevail over any other document.
The Client declares to have read these GTC and accepts them by ticking the designated box before implementing the online ordering procedure on the website www.sweet-oil.com.
Unless proven otherwise, the data recorded in the Seller’s computer system constitutes proof of all transactions concluded with the Client.
The products presented on the website www.sweet-oil.com are offered for sale worldwide.
In the event of an order to a country other than metropolitan France, the Client is the importer of the product(s) concerned.
Customs duties or other local import taxes or state taxes may be applicable. They shall be borne by the Client and are the sole responsibility of the client.

Article 3 – Order:
3.1 Prices:
The prices of the products available for online purchase on the SWEET OIL website are indicated in euros (including VAT) and are those in effect at the time of the Buyer’s order. The prices of the products may be modified by SWEET OIL at any time. The prices of the products may be modified by SWEET OIL at any time.
These prices do not include shipping costs, which are invoiced in addition to the price of the purchased products. The shipping costs will be indicated before the Buyer records the Order. The different shipping methods are provided for in the GTC below.
3.2 Products:
It is the customer’s responsibility to select the products they wish to order on the website www.sweet-oil.com, according to the following procedures:
The customer chooses one or more products and adds them to their cart, which they can remove or modify before validating their order and accepting these GTC. They will then enter their contact information and select the delivery method. After validating the information, the order will be considered final and the customer will be required to make payment according to the specified terms.
In accordance with Article L. 111-1 of the Consumer Code, the Buyer may, prior to placing their Order, become acquainted with the essential characteristics of the product(s) they wish to order on the SWEET OIL website.
The information on the product packaging is available in French.

3.3 Product Availability:
The offers presented by SWEET OIL are valid as long as they are announced on the website and within the limits of available stock.
In any case, in the event of total or partial unavailability of products after the Order has been placed, the Buyer will be notified by email as soon as possible regarding the unavailability of the product and the total or partial cancellation of their order.
In the event of total or partial cancellation of the Order:
– The SWEET OIL Customer Service will contact the Buyer to inform them of the cancellation of their Order and offer them the opportunity to place a new order, excluding the unavailable product(s).
– In accordance with the provisions of Article L 121-20-3 of the Consumer Code, the Buyer will be reimbursed for the price of the unavailable product(s) as soon as possible.
3.4 Order:
Placing an Order implies acceptance of these General Terms and Conditions of Sale and the Legal Notices.
The Buyer has the opportunity to review the details of their order and correct any errors before finalizing it.
Once the Buyer confirms their order by clicking on the “Validate your payment” icon, they are considered to have accepted the contents and conditions of the Order, including these General Terms and Conditions of Sale, the prices, volumes, characteristics, quantities, and delivery times of the products offered for sale and ordered by the Buyer.
Once this step is validated, the Buyer cannot cancel their order.
Upon receipt of the order, the Buyer may exercise their right of withdrawal in accordance with the provisions set out in Article 6 of these General Terms and Conditions of Sale.
The sale will be final at the time of the order by the Buyer. This order will be confirmed by SWEET OIL by sending an email to the Buyer (the “order confirmation email”).
Furthermore, SWEET OIL reserves the right to suspend or cancel any order and/or delivery, regardless of its nature and level of execution, due to product unavailability, non-payment by the Buyer, or in the event of fraud or attempted fraud related to the use of the SWEET OIL website, including previous orders.
A second email will be sent to the Buyer upon shipment of their order.
SWEET OIL recommends that the Buyer keep both email communications. The Buyer is informed that the two emails will be sent to the email address entered by the Buyer at the time of ordering.
Thus, in the event of an error in entering the email address concerned, or non-receipt of the Order confirmation email, SWEET OIL cannot be held liable. In this case, the sale will be considered final (except in cases where the order is canceled by SWEET OIL).
Article 4 – Payment:
The price is paid through secure payment methods, as follows:
– Payment by credit card (Stripe)
– Payment via PayPal
The order is payable by the Client in full at the time of the order.
Payment data is exchanged in encrypted mode using the protocol defined by the approved payment service provider involved in the bank transactions carried out on the website www.sweet-oil.com.
Article 5 – Delivery:
5.1. General Rules:
The products ordered by the Buyer in accordance with these GTC will be delivered to the address indicated by the Buyer as the delivery address on the respective Order (“Delivery Address”).
We deliver within France and internationally.
If delivery is not possible to the country indicated by the Buyer in their delivery address at the time of placing the order, the SWEET OIL customer service will contact the Buyer by email to consider either canceling their order or paying a flat fee for delivery to the indicated country.
5.2. Delivery Methods:
The Buyer has the option to have the products delivered by post (Colissimo or Chronopost) or through Mondial Relay pick-up points, at the applicable rates set by these transport companies.
Regarding the delivery conditions, the buyer should refer to the general conditions of the carrier, available on their website.
In certain countries, delivery through UPS or DHL may be available.
5.3. Procedures to be followed when the package is damaged or not received:
In the event of a damaged parcel upon receipt or non-receipt of the parcel, the buyer undertakes to notify the carrier as well as SWEET OIL within 48 hours following the receipt of the parcel. The buyer must turn against the carrier and initiate legal proceedings against it.
SWEET OIL is not responsible for losses and damages of the carrier chosen by the buyer.
In the event that the package is returned to the sender, therefore SWEET OIL, no refund is due. Not picking up your package at your relay point is not a form of right of withdrawal.
Once the returned package has been received by SWEET OIL, re-shipment at the buyer’s expense will be offered.
SWEET OIL is not responsible for the carrier’s losses on the return of the package, and reimbursement or re-shipment cannot be offered in this case. The buyer must turn against the carrier and take legal action against it.
5.4. Procedures to be followed in the event of missing or damaged product
The Buyer or the recipient of the Order must report the absence or damage of the product to the SWEET OIL Customer Service using one of the contact methods provided in the “Contact Us” section.
The Customer Service may request any information regarding the identity of the Buyer or the recipient of the Order and carry out any necessary verification to investigate the reported anomaly in the order.
5.5. Delivery Times:
The delivery times to metropolitan France depend on the chosen carriers:
– Colissimo La Poste: 2 to 3 business days
– Mondial Relay: 3 to 5 business days
The indicated times are estimates and correspond to average processing and delivery times.
Note: The delivery times start from the sending of the second email “shipment of the order.”
Article 6 – Rights and Withdrawal Period:
Before any return, the buyer must contact SWEET OIL’s customer service using one of the contact methods provided in the “Contact Us” section to obtain prior return authorization and to be given return instructions. SWEET OIL does not accept packages or letters sent with postage due or without prior approval from customer service.
6.1. Withdrawal Period:
In accordance with Article L. 121-20 of the French Consumer Code, the Buyer has a period of fourteen days from the day of receipt of the parcel containing the ordered products to exercise their legal right of withdrawal.
6.2. Consequences of Exercising the Right of Withdrawal:
The Buyer exercising their right of withdrawal in accordance with the conditions specified in this article regarding the time frame and return procedures for the products, may receive a credit, exchange, or refund (depending on the case) corresponding to the amount of the returned products, provided that the product(s) are unopened and returned in their original condition. Otherwise, SWEET OILreserves the right to not accept the return of the product(s).
6.3. Return Costs:
In accordance with Article L121-20 of the French Consumer Code, the return costs will remain the exclusive responsibility of the Buyer.
6.4. Procedures for Exercising the Right of Withdrawal:
The right of withdrawal can be exercised by the Buyer or the recipient of the Order by returning the relevant products by postal mail with delivery against signature.
Before any return, the buyer must contact SWEET OIL’s customer service using one of the contact methods provided in the “Contact Us” section to obtain prior return authorization and to be given return instructions.
The Buyer can only exercise their right of withdrawal on the condition that they have neither used nor even tried the products.
The returned products will only be accepted if they are intact and in their original packaging. The products must be accompanied by the order number. Returns of products sent back beyond the 14-day withdrawal period will not be accepted.
Upon receipt and after a quality control of the goods, SWEET OIL has a period of 30 days from receipt of the goods to reimburse the customer or make an exchange if the buyer wishes.
SWEET OIL does not accept packages addressed postage due, nor sent without prior contact to customer service.
Article 7 – Liability:
7.1 Capacity:
The Buyer, prior to placing an Order, declares to have full legal capacity to enter into the present General Terms and Conditions of Sale. SWEET OIL cannot be held responsible for verifying the legal capacity of its visitors and Buyers.
Therefore, if a person without legal capacity were to order items on the SWEET OIL website, their legal representatives (parents, guardians) would assume full responsibility for the order and must honor it.
7.2 Usage:
The seller disclaims all liability for the buyer’s use of the products. In no way do the comments and information provided on this site constitute a recommendation for treatment (preventive or curative), a prescription or a diagnosis nor should they be considered as such.
SWEET OIL assumes no liability for the consequences that the use of this information could have. Furthermore, the photographs reproduced on the website illustrating the presented products do not enter into a contractual scope, as well as any errors in the product description. The seller’s liability cannot be engaged if an error has occurred in any of these photographs. The seller undertakes to exchange any defective product at their own expense. This warranty does not cover any failure related to abnormal use or storage of the product due to negligence or fault of the consumer.
SWEET OIL cannot be held responsible for any non-compliant use of the products sold on its website.
SWEET OIL’s liability cannot be retained for any damage caused to the Buyer or a third party as a result of such non-compliant use.
Testing the product on the inside of the elbow 24 hours before using the product is an essential rule to follow to detect any allergic risk.
SWEET OIL disclaims any responsibility for misuse of a product or allergic reaction.
Hypertext links may refer to other websites than the present one. SWEET OIL disclaims all liability in case the content of these websites violates current legal and regulatory provisions.

Article 9 – Intellectual Property:
The SWEET OIL trademark, as well as all figurative or non-figurative trademarks, product names, and all illustrations, images, and logos, and any content appearing on the website, are and remain the exclusive property of SWEET OIL.
Any total or partial reproduction, modification, or use of these trademarks, illustrations, images, logos, or any other content on the website, for any reason and on any medium, without the express, written, and prior consent of SWEET OIL, will be subject to legal action.
Article 10 – Applicable Law:
These general terms and conditions are subject to French law. French law and French courts have jurisdiction in the event of a dispute or litigation between the Parties.
Article 11 – Force Majeure:
The Seller’s liability cannot be invoked if the non-performance or delay in the performance of one of its obligations described in these general terms and conditions arises from a case of force majeure within the meaning of Article 1218 of the Civil Code.
